Trip scheduled changed - what are my rights?

    I don't care if they provide reach arounds on the RRIII, and hand feed you Toro sushi at the same time. I don't care if the boat is the greatest things since slice bread. The question and argument is simple. Do they owe the OP the 3.5% that they charged him, after THEY changed the trip plans.

    The answer is simple...yes they do.

    One has nothing to do with the other.

    All of this BS over what amounts to less than $50?

    If the OP read the terms of payments he would have noticed he was subject to a $250 booking fee.

    "All cancellations are subject to a $250.00 non-refundable booking fee or 10% of the cost of the trip. No exceptions."

    Pretty standard wording throughout the industry.

    To me it seems he should have stayed on the trip. It's a great time to go and they added an extra day and it's a charter! My guess is the charter master and all of the regulars are OK with an extra day of fishing.

    I think there's something the OP isn't telling us.

    Sorry but the OP didn’t cancel out of the trip he signed up for. They changed the trip and he couldn’t fit it in his schedule. He should have no cost to opt out of the changed trip. To be fair, since they can charge us $250 to cancel they should pay us the same amount if they cancel.
    I love the RR III and would not hesitate to fish them, and this discussion won’t change my mind. I actually think it’s a misunderstanding since the cc fees will be fully refunded by the cc card company anyway. As someone mentioned, contact Linda and I’d bet she’ll straighten things out and make it right.

    For the 50th time, tell your credit card company what happened and it will be taken care of. There is NO WAY the boat can keep your money if what you're telling us is the full true story.

    It will be an open and shut case for them I promise!

    Here's something that hasn't been mentioned: some companies make policies that are in direct violation with consumer protection laws. This is pretty common with Lemon Laws/consumer electronics. It really doesn't matter what's in the terms and conditions that you sign in agreeance too, they still actually can't do that. Not necessarily the case here, but something to make note of. Always good to know what your rights are in situations like this, as contract law is always tricky.

    I guess you haven't rode the Big X, Since Bill Poole sold it. I've had better food at a ball park. Not greasy/fatty ribs, The chicken has more skin, bones than meat, Rice with alot of meals, ONE egg benedict, one piece of bacon and sausage and ONE PIECE OF TOAST. Only snacks put out are oranges (not navel) and apples. Their appetizers they put out are on the cheap size and you better be the first to get them or tuff shit. No chips, crackers, candy and real fruit. When Justin cooked in the galley when Bill Pool owned it,, The food was night and day to compared to now. To answer your question, I would pay 5% fee for getting screwed and have better food!!!!!!!!!!!!!

    AS I STATED, If he speaks with Linda and not office help, She would probably refund the 100%. I'm so sure she will and if she doesn't I'll personally refund the guys cc fee, providing he speaks directly with Linda. That's how sure I am.

    You seem to know the RRIII operation well. Maybe the Owner is not aware of this Thread. Maybe the OP tried to talk to the Owner, but did not get a return phone call for whatever reason. Perhaps she is out of town and cannot be reached. The OP already stated that he called his CC company for clarification.

    Since you know the operation so well, perhaps you can make a phone call on behave of the OP, explain the situation, and let all of us know what the Owner has to say? A post from the Owner is one way to settle this matter. Another one would be for the OP to let us know what his CC company did.

    Your loyalty to the RRIII is appreciated. I'm sure there are many others like you. It's a fine operation.

    The boat's office has made a decision to refund my deposit including the 3.5% convenience fee and the refund will be credited to my CC.
    I am 100% satisfied. Again, thanks to all who gave sensible advice. I truly appreciate your inputs.

    He probably didn't speak to Linda, She is one the nicest persons and would not screw anyone out of a red nickle. I've known Linda, When Maryann Grabowski worked their about 40 years ago. Like I stated the girl in the office probably doesn't know any better(she has only been their for about a year) And it's not to often they change the schedule.

    Man, this thread is ridiculous. Customer should get 100% back. Was not his fault.
    I had an 8 day booked and fully paid for, got a call that the trip was cancelled.I freaked but there was another 8 day a month later, called the boss and was able to change my vacation time. Owner refunded a $ 500.00 credit for my troubles. Great customer service, wasn't my fault.
    Just recently I had to cancel a 10 day trip that I had a $ 1000.00 deposit on. Lost $ 30.00 for c/c fee's. No biggy, my fault.

    If you are a office worker you follow the bosses rules... situation probably never came up. Extended trip usually favors the passenger and we are talking about 50 bucks for cc charges. (Which in principle was not Johann’s problem that the trip dates changed) Just glad the right move was made...
