OK Lee, this is my attempt to calm the waters here and try to explain to you what 28.95 is........ And I'm being friendly so don't get pissed off.
28.95 Consider it a definition. This section acknowledges a spear, harpoon, and bow and arrow as acceptable piece fishing equipment. That is pretty much all this section is for.
28.90 takes it a step further and focuses more on the specifics related to the use of a "speargun" stating the person must be in the water either swimming or floating. your skin needs to be in actual contact with the water.
The harpoon is not the issue in this case.......... I spearfish quite often and I would hate to lose this privelage because of a careless person and his disregard for the rules and regulations. Everyone needs to familiarize themselves with the rules and regulations. They are always being changed/ammended.
What this guy did, shooting at a fish from his boat violates the regulation/law. What he did could have possibly violated the law stating you cannot waste or cause deterioration of a fish.
When you use the word "wreckless" replace it with the word careless and think back to what he did.
I hope this helps you out. People doing things that violate regulations/laws impact the rest of the fishing community. When things like this go to court, case law can change, restrict, or even end our fishing privileges.
