Need some legal advice. I sold a boat, getting sued....

    Need some clarification.

    Post indicates he's gotten multiple tickets?

    Where is he parking it that he's getting multiple tickets?

    When did the trailer registration expire, before or after the sale? If before, pay the registration and resolve the (1st) ticket. It was your fault and misrepresentation. Pay for no more than one ticket, as it's his fault for not resolving it immediately and for keeping it in a location where it was vulnerable to getting tickets.

    If the guy bought a used boat with the intention of flipping it for a profit, he's a dumbshit. Boats are not liquid assets and used boats are a tough sale. It's even more important to protect yourself with buyers like this with a written contract stating he's acquiring it as is, including stating the accurate status of the registrations.

    How much did he give you for the boat?
    Sounds like taking the boat back & returning funds, selling it to someone you dont know would be best...
    Sounds like this guy is a piece of work from your side of the story, he's just going to bug you issue after issue...

    Rob Sanford is going through a tough time in his life ! Please refrain from bashing his ass. I will admit he jerked me around when he owed me money, I will also admit he made it more than right when all was said & done. But he is now missing a finger LOL

    If he had gone to the dmv and transferred the boat and trailer into his name he would have found out immediately that it was expired instead of after the got ticketed....if the ticket was more then 30 days after the sale then it's all on him.

    did you ever transfer the trailer registration into your name? From the facts you presented it doesn't look like it and a judge may find for him just to punish you for that.who knows ..it's small claims court...they have an attorney free of charge there at the court(or they did at least 18 years ago) to give you advice on the case but they don't appear for you.

    No I had not transfered the title in my name. After I bought the boat, I also figured out the guy I bought it from hadn't either. There was no "Transfer of Liability" to fill out. The same was when I sold it to him, which may or may not bite me in the ass. I believe that since there was no transfer of liability, he is not responsible for the fees, and since I didn't fill one out, neither am I. It falls on the last person to buy the boat that filled out that document

    sounds like this guy is a bus chaser I'd pay the damn thing and have him sign a contract that you payed for the ticket and in return he never talks to lears at calls walks by my house and never contacts me again in any way shape or form

    I didn't see anywhere about whose name is on the registration for the trailer...I'm assuming the last owner? then you flip it and this guy tries to register and is tagged with all the fines...is it known how much for all the fines/registration? I would think unless its stated in a bill of sale that you are responsible, the buyer or person making the transfer of ownership would have to pay the fees/fines.

    If he's a jerk tell him to stick it and go to court if he has the sack. What's the worst that can happen, I would also tell the Judge you already gave the idiot a Battery trying to satisfy his ridiculous demands. Of course talk nicer in court. The judge might rule your responsible but so be it.

    All of the transfer fees are the responsibility of the buyer.

    true. but does that ^ assume you've done the transfer of liability? in this case i do not believe OP did that.

    He tried to sell this boat without putting it in his name......when you buy a vehicle /boat you have 10 days to register that vehicle.....he didn't do that.....that is against the law and will make him liable for all fees.....

    Couldn't find out what happens on the 11 day :) he did say he owned for less that 2 weeks....but check this out

    ...all the guy (buyer) has to do is request a waiver and that might solve everything...
    Waiver of Penalties and Registration Fees

    9562. (a) When a transferee or purchaser of a vehicle applies for transfer of registration, as provided in Section 5902, and it is determined by the department that registration penalties accrued prior to the purchase of the vehicle, and that the transferee or purchaser was not cognizant of the nonpayment of the fees for registration for the current or prior registration years, the department may waive the registration penalties upon payment of the fees for registration due.

    I've bought and sold more than 100 cars.....a lot had back fees.....never once did the DMV waive any fees.......ever.....
