    to the brother who used the asian dude with the shorts in his pants as an example ...... unfortunatly for the asian dude that was just genetics and he is still running around with his short in his pants ... But truly the problem with rude people boatin or at the ramp or on cattle boats is the same problem everywhere you go ... they are rude at the store on the road, at the airport or church parking lots after services ... I try to just shake my head and have a little patience , wish these rude people a little aloha and remember what comes around goes around , of course I dont always take my own advice .. so when im not I give them rude guys the finger and say have a nice day !

    Wow. Sure will be glad when spring comes. Tommy I guess you are right about getting called out for what you do everyday.

    There is NO store selling california spinny lobsters, you might see aussie ones at cost co and other stores, or even the florida ones, but you will not see california/mexican spinny lobsters, (unless the ones from mexico are from way down south0. PERIOD. so for all you arm chair wanna be commerical guys, you are poopie pants, now everyone get in the:gaygroup: and learn what each lobster tail looks like without a body attached...

    speaking of hockey, i was at the kings game tonight, overtime shoot out,,, pretty cool. long drive home tho

    For all of you that put tommy up there with XXXX, you should realize they are only human and can make a mistake. This is not a big mistake. If you are freezing bugs, you are better off tailing them. He is also not the only person fighting for our rights to fish. You should all join in on the fight instead of saying Tommy will do all the fighting for us.

    Here is the new DFG lobster brochure with link below:
    "Preserving and preparing the lobster catch
    By law, spiny lobster must be kept whole and not tailed until brought
    ashore, so size can be determined.

    This was followed up with a phone call to SD DFG who recommended keeping them whole but said it is not the law. The DFG said the law is upon entering the shore they must be measurable but not a week later in your freezer.

    A judge agreed with me in court and cost me no $$$, the DFG regs I have found agree with me and a DFG agent agrees with me. Do what you want to do.

    Thanks everyone for trying to point us in the right direction so that we do not get in trouble or fined. I am still looking for my 7 legals and they won't be placed in the freezer! They will be grilled and gone!

    California Fish and Game Code Section 5508 states "It is unlawful to possess on any boat or bring ashore any fish upon which a size or weight limit is prescribed in such a condition that the size or weight cannot be determined." Separating the tail from the carapace (body) makes it impossible to determine if the lobster was of legal size; the animal must remain whole until you are ready to cook it. If cooking for immediate consumption while at sea, retain the carapace until the tail is consumed.
    If Im reading this right, it says that lobsters must be kept whole until you are ready to cook them for consumption!

    Here is California fish and game code section 5508 as it reads straight from the regulations; In it's entirety.

    5508. It is unlawful to possess on any boat or to bring ashore any
    fish upon which a size or weight limit is prescribed in such a
    condition that its size or weight cannot be determined.
    The commission may adopt regulations, under which fish other than
    whole fish may be brought ashore, which establish sizes or weights
    for cleaned or otherwise cut fish equivalent to sizes or weights for
    whole fish.

    Where does it state the animal must remain whole until you are ready to cook it?

    What you wrote above, was that in your own words about keeping the animal whole until you are ready to cook?

    As I read game code section 5508 the rule is in regards to being on a boat or when you come ashore the tail needs to remain intact to determine size legality. Once you have gone home there is no law prohibiting you from "tailing" your lobster and storing it however your heart so desires!

    Chris, It says the live ones are CA lobsters. They say they are the same as Australian, and then say they have tails for sale.

    Sounds like the tails could be from Oz.

    I'll try and give them a call and see for sure.
    On a side note.....
    A family member, who lives in Prescott, found some tails in Walmart (this was back in 2007). I had some spiny tails laying down next to his, and they appeared to be the same. However, I am not an ichtiologist, but any lobster at the Walmart Superstore is a little strange...
