It's not that difficult to follow the rules. We are all responsible for knowing them and following them and if cited would have the fun of fighting and paying for it too. If it's a grey area, I for one would not take the chance.

all the arguements aside, i fished S.D. bay last night as well found a nice lil patch of ground that hasnt been totally raped and managed 3 legals in about an hour and a half. one nicer model two just legal. seamed the bugs really liked the deeper water 40+ was best alot of shorts over twenty. all the shorts were females two small male keepers and one bigger female no eggs. there there just goota work for em.

Obviously Tommy just because I registered in May of 08 and have only posted 8 times does not mean that I started hooping in May,,, don't be silly. I started hooping in 1986. As Scotto stated the rule is for when you return to shore your lobsters need to be in a measurable state. I.E. tails intact with the body. What you do at your home to store your lobsters is not for D.F.G. -----Perhaphs the law for a business that sells seafood is governed by a different set of rules. Perhaphs you may not posess and or sell "tailed" lobsters. If I am mistaken then so be it. I learned long ago that I will never be right about everything. Sorry if I offended anyone, that was not my intention. Later, Dave

Damn Tommy, talk about a "drama queen"....

You seriously are way too worked up. Just point out the chapter for all of us peons to look up that pertains to the illegality of "tailing" your lobsters. Or how to store your catch once you arrive home.

    George,
I agree that we all must be part of the solution and inform individuals that break the rules. But if you believe there is enough DFG Agents to resolve the problem then you are kidding yourself. Great example is walk along the San Diego harbor (habor island) and see how many short bass are kept. I have not seen a DFG in that area in over a year. Tell me it's going to get corrected magically. DFG are understaffed. This is not going to change suddenly because of budgets. I don't see more funding being place in this segment for enforcement. I get the self enforcement by all, but individuals that are taking shorts (lobsters) are probably doing this on purpose. It's pretty bad when a BD poster puts undersized halibut & WSB and talks about what a great day fishing he had while the dead undersized fish are sitting in his ice box. Sorry about the rant, but continuing like we are will result in closures. Time for more enforcement agents so closures can be avoided or at least reduced.

I have seen Australian lobsters with only tails, so I hope these are not what is being considered as local lobsters.

Tommy is one of the Regional Stakeholders for the MLPA process and he represents us. He knows his stuff and his posts have been to inform and educate us; you can take or leave his recommendations. He does not receive any pay for all the time he puts into the Regional Stakeholder position and his posts, in my opinion, are to look out for us to keep us out of trouble.

I too have seen what Steve (Bottomline) describes and I have wondered how the stores have gotten away with selling the tails without the rest of the body. Are they taking chances? As for me, I have tossed back the many shorts caught on my last few hoopin trips and have nothing to worry about with having any lobster in my freezer! I look forward to catching some legals to bring home before the season ends!

How does the DFG or anyone else tell a California Spiny lobster, from one caught in Mex. or elsewhere by looking at it? A business ie .PLS, or Tommy, I would imagine would have a paper trail, but for John Q. Public at some point "enforceability'' becomes pretty sketchy IMO once you leave the the water, shore area..BTW By no stretch of the imagination am I condoning, stretching the interpretation of the law or keeping shorts.

I'm sure the ones in the stores are imports - Albertsons had a huge pile of them last Friday - they were tiny tails from Brazil.

My concern was the hypothetical situation I posted concerning live local lobsters sold to the public - Tommy informs folks of the regs - I don't believe this happens at other retail locations and was just wondering what the non-fishing publics liability would be. We fishing folks are supposed to know/follow the rules and I'm reasonably sure that most of us do.

I am real tired of trying to get my point across so I'll just shut up now.
