Ahi Fever - Needs help

    DLNR is Extorting AHI Fever's permit unless we hire DLNR officers for security. We’ve had our permit request turned in since December. I talked with other club/tournament directors and check this out other clubs and tournaments do not even have to hire security. They just have to check the block to say that they have security. But now they want/will mandate it, NOW that we have less then three weeks to go? The request form does not state you have to have security just a block that ask if you have adequit security. Ahi fever Board of directors did this as a great "IDEA/SAFETY MEASURE" to have security. Other tournaments also have their permits for tournaments scheduled in the future coming months and did not have to succumb to such harassment from the Dept. but they already have their permits approved (past June). We also was told last week that the only reason for not having the permit approved yet was that they were working on Next month (JUNE) permits and would surely get to ours soon. Even when questioned that other upcoming tournaments has had their permits in hand and APPROVED!<?XML:NAMESPACE PREFIX = O /><O:p></O:p>
    Up to 2008 we hired DLNR and had no problem with the security they provided including what the officers charged and we even feed them. Money that comes from the fishermen help pay for this through the entry fee and some come from the club through sales of shirts and advertising. During the 2009 preparation for Ahi Fever the head of DLNR (Laura what’s her name) waited to the week before Ahi fever to inform us she was only going to approve the permit only if we hired her handpicked people. Which drives the cost way up! So not to raised the price of ahi fever entry fee or cancel the tournament we opted to say no thanks and hired HPD. That turned out to be great for them (HPD) and us. We got uniformed officers, police cars, sirens and for them they got a signup sheet for people to be assigned for their time. All we paid for was the normal working hours salary and they figured out among themselves who was to work what shifts and times to cover the whole weekend. Even though we had security re-assigned to HPD she still threatened to not approved the tournament permit. It wasn’t until we agreed to cancel the tournament and return the monies back to the entries with a letter as to who, why and what! Also got help from the governor’s office which help us keep Ahi Fever Alive in 2009.
    That’s the same thing that is happening right NOW in 2010.<O:p></O:p>

    I believe the head of DLNR "Laura Thielen" is a Republican. She was appointed by Republican Gov Linda Lingle. She's the daughter of GOP Rep Cynthia Thielen.

    Wow, Im really looking forward to hanging out with all the fishermen during Ahi Fever weekend. This is really a bum trip and I will never support DLNR whether it happens or not. Just the thought is outrageous!
    Someone tell me where the hell did the all the Aloha go?

    I am passing the information from the president of Ahi Fever, Mr. Norman Swift. Please pass the information to other ocean users who you trust. Basically DLNR is holding up their permit for Ahi Fever since December and now just told them in the last minutes that they have to hire DLNR personnel to get the permit. DLNR staff, William Aila, also mentioned that they are mandating this new law to all clubs and tournaments. Below is Norman's messages:

    "This form or mandating this and waiting until last minute to notify the applicant early should be against the law. Also no paper work given to me or sent to us about any changes and what the new law is and what is mandated. What I used to hire as a extra safe measure is what they ask me to mandate not what they have as mandated..What kind of law is this..please pass the word around to other Fishermen so they know our club will back anything to get her out of office and her communist attitude. This kind of extortion will stop all or most non profit activities..Every club will need to add more fees to the expense of the tournaments. I have been on the phone all morning and not getting and answer as to what I can do to follow their rule, what ever it is you can't get a hold of anyone and these are the people we HAVE TO hire. Our tournament is held on the weekend and as everyone knows if you call DLNR on a weekend, all you get is a Code-a-phone recording saying call HPD. So why can't we just Hire HPD. We are forced to do as they ask for this years tournament because they told us to late but I'm not sure we will go thru them next year and we will have a whole year to contribute to stopping all this illegal extortion rules by a dept that is not held accountable for anything they do."

    i say relocate the tourny to the capitol building and protest. the one thing i hate about hawaii is the corruption in government.

    Last night I ,Norman and Bonita Swift, Clarence and Lani Sylva, John and Coralene Swift, represented WBFC and Ahi Fever Tournament, attended a Coalition for Fishermen meeting at POP and was real informative. I have done some of the things they suggested but I need to write a few more things down, DLNR does not recognize any e-mail or voice notification, everything has to be hard letters only. I did e-mail the ombudsmen and things really got rockin yesterday but they still forced me to hire DLNR or give them first chance to work security before I can call HPD to fill our security needs.<o:p></o:p>
    I had to give them a schedule and they will tell me if they will come or not ,No commitment for sure like HPD does. I told DLNR that there is a couple of Flaws why I didn't want DOCARE and wanted HPD, 1st is- DOCARE doesn't have a blue light and I hired last year all officers with their light , which is a deterrent from teenagers drinking and coming to the harbor because they will need to pass HPD. 2nd- if a problem arises where the problem is in the C&C parks area which I also have a permit for, DOCARE doesn't offer any help and there fore would not contribute to assisting HPD, where a HPD officer will be able to cover all areas, 3rd- is that on weekends DOCARE has no one to call if help is needed at the harbor , DOCARE or DLNR has a recording to call HPD so on weekends HPD is the officers of choice and our tournament is on a weekend. 4th is- DOCARE cost more and don't give the coverage of HPD which has jurisdiction over all the state facilities including arrests, and investigations. AFTER arguing my points with William Aila he has ALLOWED me to hire one DOCARE and one HPD during night hours but day time I have to request a DOCARE officer first if they cannot find someone then I can ask for HPD. This schedule is going to let our permit go thru .<o:p></o:p>
    Although it is going thru after all this negotiating brings out a few problems , one we are forced in getting second class protection, and second they held up our permit because of this and lied about the holdup which is now evident and destructive to events. Third William Aila sets the guidelines for our security and nothing is written what the guidelines are. They use what we have done in the past as extra protective measures are now mandated to us as mandatory . If we only have 50 boats in a given year we will still need to have this security because we set the pace to protect our tournament on a volunteer basis.<o:p></o:p>
    Another point to consider is the difference in Harbor masters being able to set the rules for security or conditions of the permit, which is why one tournament NEEDS to have x amount of security by DOCARE and another harbor doesn't. Another problem is DOCARE if they don't show will put another HPD officer in Harms way, where if a HPD officer cannot show up , HPD itself will find a replacement and it is guarantee. Make note that We now have this agreement to receive our permit by Friday.<o:p></o:p>
    I am not a happy camper and feel I'm not getting the best for our tournament, as proven last year without any DOCARE officers how well everything went, and they didn't even feel it was important to send a regular shift DOCARE officer to check last year but it is mandatory for us to hire them this year because it's state property. They have DOCARE officers working on weekends as their regular schedule, is it only important when we HIRE them to come to Waianae. Not a very good example of urgency is there. If you pick up the phone and call DLNR on the weekends you will see the unimportant procedure by DLNR recording 'call 911', DOCARE is not even in the loop of 911. If they need anything on the weekend they will call 911 not another DOCARE officer. <o:p></o:p>
    Last you can show this letter to whoever you want and with my blessing. Although I have confirmed to their rules to get our permit, It does not mean I agree to the rules they self governed on us and to let everyone know they have clauses to cover this in their HRS regulations where they can do this kind of things lawfully, all fishermen need to be aware of all the rules they can inflict on us at any time with no recourse for the private sector to appeal or a panel to send an appeal to. <o:p></o:p>

    Yet another rule they are stuffing down our throats without proper notice and hearings. This cannot be legal.

    I feel your pain. I put together a 3-day surfing contest on Oahu last year and it was an absolute night mare dealing with the government's security and lifeguard requirements. I swear it's a mafia as I could only hire a certain person, and cost us thousands and thousands of dollars per day in what I felt was bogus fees. It completely wiped out my club's funds and we had nothing left for prizes, etc. Needless to say, my organization and I will NEVER ever put on another formal contest in this state.

    DLNR,IRS i hate both of them............find the people we need to vote out and lets make a stand... fishermen will unite and boy we sure have a large commitee lets do something about it!!!!
